In 2023 Governor Kemp signed HB 121 that provides for the voluntary registration of multipurpose off-highway vehicles so they may be driven on county roads. It’s important to note that it’s not required to register your off-road vehicle, but if you plan to drive it on a county roadway they must be registered.
Does my vehicle qualify?
Only multipurpose off-highway vehicles (MPOHVs) manufactured after January 1, 2000, may be registered. MPOHVs must have “features specifically intended for utility use” like:
-They must be rated by the manufacturer to operate at speeds between 25-65 mph.
-They cannot be wider than 80 inches, must have a gross weight rating of less than 4,000lbs and must have a cargo capacity of 350lbs.
-Must travel on four or more wheels, use a steering wheel and use a non-straddle seat.
-MPOHVs must have headlights, brake lights, taillights, a rearview mirror, and seat belts.
What qualifies as a UTV?
Utility Task Vehicles (UTVs) are designed with four wheels or more and incorporate a steering wheel rather than handlebars. Some UTVs can accommodate up to six passengers. They usually have side-by-side seating and seatbelts. All MPOHVs are eligible UTVs that have been registered and received a tag.
What’s the difference between UTVs and ATVs?
All-terrain vehicles (ATV) are also designed with four wheels. They generally accommodate one rider and are operated with the use of motorcycle-like controls including handlebars. the operator rides “on” an ATV versus “in” a UTV. Only UTVs are eligible to be an MPOHV.
Is insurance required for MPOHVs?
Yes, eligible MPOHV motor vehicles driven on eligible roads in Georgia must have the same minimum liability limits ($25,000/$50,000/$25,000) as other motor vehicles.
What type of coverage should I look for?
MPOHV coverage is often written by insurance carriers using the forms also used for Motorcycles. As over-the-road motor vehicles here are some options:
Bodily Injury & Property Damage Liability (this is mandatory for registered MPOHVs in Georgia)
MPOHV insurance coverage offers Bodily Injury and Property Damage Liability to pay for injuries to people or damage to property caused by insured MPOHVs.
Other than Collision (this is an optional coverage)
In most circumstances, Other than Collision (what is often called “Comprehensive” coverage) MPOHV insurance coverage pays for damage to a MPOHV if it's caused by an event other than a collision. For instance, if the MPOHV is damaged by fire, theft, vandalism, flooding, or contact with an animal, Comprehensive coverage will likely apply.
Collision
Collision pays for physical damage to a MPOHV if it hits another vehicle, a tree, a parked vehicle, a big rock, a stump, a fence post, or other obstacle.
Medical Payments (this is an optional coverage)
MPOHV insurance often includes Medical Payments, which pays for insureds or permissible operators if they incur bodily injury as a result of an accident during the policy period. A limited amount of coverage is available and is paid regardless of who is at fault for the accident if otherwise covered.
Uninsured Motorist (this is an optional coverage)
Uninsured Motorist (UM) coverage can pay for your loss due to be involved in an accident with an uninsured driver or an underinsured driver when you suffer a loss that is not fully covered by their insurance. In Georgia UM also includes Underinsured Motorist (UIM)
